Mënaji Terms and Conditions
The use of this Site is subject to the following:
You may become a registered user with an account on our Site, however, it is not necessary to do so in order to make a purchase. If you do become a registered user, you must provide an email address, username, password and such other information as we may require from time to time. You are solely responsbile for maintaining the confidentiality of your username and password as well as restricting access to your computer. In addition, you are solely responsible for all activity that takes place within your account. We may cancel an account or an order that has been placed without prior notice that in our sole discretion we believe violates this Agreement. If a US citizen or legal resident of the United States, you must be at least 13 years of age (except for Maine residents, who must at least 18 years of age).
Items available on this Site and any samples or free gifts that we may provide are for personal use only and may not be sold or resold. We reserve the right to refuse to process an order due to suspected fraud, unauthorized or illegal activity or that violates the terms of this Agreement.
All content presented on this Site is the property of Menaji or its content suppliers and is protected by United States and international copyright laws. Product images, logos, trademarks and any service marks displayed on this Site are the registered or unregistered marks of Menaji, our affiliates, partners or licensors and are protected by United States and international trademark laws.
Feedback and Submissions and Indemnification
We welcome your feedback about our products and this Site. Any submission you provide, including feedback and questions, is treated as non-proprietary and non-confidential. By making a submission, you grant Menaji an irrevocable and unrestricted license to use, modify, reproduce, transmit, display and distribute such information for any purpose whatsover. You represent and warrant you own or otherwise control the rights to any submission and that such submission does not constitute or contain software viruses, commercial solicitations, chain letters, mass mailings, or any form of junk mail. You further represent and warrant that you will not impersonate any person or entity using a false email address or otherwise mislead us as to the origin of any submission.
You agree to indemnify Menaji for any claims arising from or in connection with any claims arising in connection with your submission.
We grant you a limited, revocable and nonexclusive license to access and make personal use of this Site. The laws of the State of Connecticut, without regard to principles of conflict of laws, will govern this Agreement as if this Agreement were a contract wholly entered into and wholly performed within Connecticut and any dispute of any sort that might arise between you and us.
Any dispute relating in any way to your visit to this Site or to products or services sold or distributed by us shall be submitted to confidential arbitration in Fairfield County, Connecticut except that, to the extent you have in any manner violated or threatened to violate our intellectual property rights or the intellectual property rights of our affiliates, partners or licensors, we may seek injunctive or other appropriate relief in any federal or state court in the State of Connecticut and you consent to the exclusive jurisdiction and venue in any such court. Any arbitration shall be administered by the American Arbitration Association and shall be conducted in English. The arbitrator's award shall be binding and may be entered as a judgment in any court of competition jurisdiction .
